What is Mediation?

Mediation is a structured negotiation process in which the independent mediator assists the parties to identify the issues in dispute, assess options and negotiate an agreement to resolve their dispute.

Mediation may be undertaken by the parties at any stage of a dispute. However our experience indicates that the parties to a dispute are usually better served by early mediation. The parties may either voluntarily engage in the mediation process or it may be Court ordered or sometimes it is required by a contract between the parties.

Nationally Accredited Mediator

At Hickey Lawyers we have a number of lawyers who are involved in mediation.

Scott Eustace is a nationally accredited mediator. He is a solicitor with in excess of 20 years experience in commercial litigation and is a Queensland Law Society Accredited Specialist in Commercial Litigation.

Scott uses his experience to quickly gain an understanding of the interests of each party, to identify the issues and to assist the parties to facilitate a resolution of the dispute.

Scott provides mediation services in relation to disputes of a general commercial nature including (but not limited to):

  • Partnership disputes
  • Workplace disputes
  • Company shareholder and director disputes
  • Corporations Act disputes involving insolvency issues
